Stolo

Terms of Use

Effective

These Terms of Use (“terms”) are an agreement between you and Stolo Systems Inc. (“Stolo,” “we,” “us”) covering the Stolo app and this website. By installing or using Stolo, you agree to these terms. This agreement is between you and Stolo only, and not with Apple Inc.

The service

Stolo provides encrypted messaging, file and voice transfer, GPS position sharing, and an emergency SOS beacon over a self-healing mesh network that runs over radio, Wi-Fi, and cellular links.

The Stolo app is free. There is no subscription, no in-app purchase, and nothing to activate.

Acceptable use

Use Stolo only for lawful purposes. Do not use it to interfere with the service or with others’ use of it. You may not use Stolo, or any system built with it, to purposefully cause physical harm to people — a restriction that also flows from the license of the open-source network stack Stolo is built on.

If you operate Stolo with LoRa or other radio hardware, you are responsible for complying with the radio-spectrum rules that apply where you operate — including permitted frequencies, power limits, duty cycles, and any licensing requirements.

Export compliance and sanctions

Stolo contains encryption and is subject to U.S. export control laws (the Export Administration Regulations) and other applicable export and sanctions laws. By using Stolo, you represent that you are not located in, and are not a national of or ordinarily resident in, a country or region subject to comprehensive U.S. embargo; that you are not on any U.S. government list of prohibited or restricted parties; and that you will not use or re-export Stolo in violation of applicable export or sanctions laws.

Not a substitute for emergency services

Stolo is not a substitute for emergency services. Stolo does not contact 911, 112, or any other public emergency service. Delivery over a mesh network depends on radio conditions, terrain, device placement, and battery, and delivery of any message is not guaranteed. Never rely on Stolo as your only means of requesting emergency assistance; when life or property is at risk, use official emergency channels first.

Warranty disclaimer

We build Stolo for harsh environments, but no communications system is infallible, and we cannot promise the service will always be available or error-free.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STOLO IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STOLO SYSTEMS INC. WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES — INCLUDING LOSS OF DATA, PROFITS, OR COMMUNICATIONS — AND OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so parts of the two sections above may not apply to you.

App Store terms

If you obtained Stolo through the Apple App Store, the following also apply:

Termination

You can stop using Stolo at any time by uninstalling the app. We may suspend or discontinue the parts of the service we operate (such as our relay node) for breach of these terms or for operational reasons.

Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules.

Changes to these terms

We may update these terms. We will post the new version here and update the effective date at the top of this page; continuing to use Stolo after a change means you accept the updated terms.
